Council Chairman Chris Loar sat in for Councilman Dempsey Lambert

Absent:	Councilman Benny Johnson	 

Meeting commenced at 5:21p.m. Councilman Kent Schexnaydre led the committee in prayer and the pledge.  Councilwoman Teri Cass arrived at 5:23p.m. and Councilman Dempsey Lambert arrived at 5:27p.m.

Public Comment Period 
Chairman Schexnaydre announced that anyone who wished to speak on any item could sign up at this time.  There were no public speakers.

Approval of Proposed Pipeline Ordinance (Rick Webre, OEP Director) 
Rick stated he was submitting the final draft of the modifications made to Chapter 8 of the Emergency Manual Ordinances.  Rick stated the only change was that DPW will continue to manage the pipeline permitting process and the Drainage department will handle the inspections of every new pipeline.  Rick said, OEP has been working with the new process for about 12 months and its meeting all the goals.  Would like the ordinance to be submitted to full council and the new ordinance be implemented by July 1, 2013.  A motion was made by Councilman Daniel Satterlee with a second motion by Councilwoman Teri Casso to move this item before full council.

Report on Animal Shelter (Kent Schexnaydre) 
Chairman Schexnaydre gave some background on this item.  At the March 11 Strategic Planning meeting there were allegations presented by the public of cruelty to animals.
Chairman Schexnaydre and Councilman Satterlee were going to look into the allegations themselves.  Chairman Schexnaydre and Councilman Satterlee both made visits to the shelter. Chairman Schexnaydre took part in a follow up visit accompanied by a local veterinarian and a local pet adoption agency.  All parties were satisfied with the shelter and the improvements that have been made.  Parish President Tommy Martinez stated that Thomas Pearce and official from St. James visited the shelter and even with all the strides we’ve made the Parish will still be $170,000 short next year.  Thomas Pearce spoke of his trip to the shelter with officials from St. James and Gramercy.  The intergovernmental agreement has been submitted for signage to St. James, Gramercy, Sorrento, Donaldsonville, and Gonzales.  Mr. Pearce will be following up with these cities.

Permitted Use Zoning Table change for zoning category MU2-to allow carwashes as a permitted use (Chris Loar)
Chris Loar spoke on this item asking the committee to send a recommendation to the planning commission to allow enclosed carwashes as a permitted use in MU2 zoning category.  Councilman Chris Loar stated he had two constituents in the past two months call about placing enclosed carwashes on Hwy 42 and Hwy 73.  A motion was made by Councilman Dempsey Lambert and seconded by Teri Casso to pass this item over to the Planning Commission for a recommendation to full council. 

Discussion of Proposed Ordinance to supplement Chapter 13, Door to Door Sales (Kent Schexnaydre)
Chief Deputy Tony Bacala spoke on this item he said, we are conveying a message their getting from the public everyday about door to door sales.  Knocking on doors trying to sell magazines or whatever they want to sale but it’s not something they’re delivering on the spot.  We trust what we pay for is what we get but that doesn’t always happen.  We’ve also has had instances where these individuals have talked their way into homes of the elderly and committed thefts and other crimes.  Mr. Bacala stated it’s a growing problem and typically when they show up our phones light up.  We’re conveying that’s it’s an industry that needs to be regulated.  We had the idea to make door to door sales illegal not talking about Girl Scouts or World’s Finest Chocolates those were excluded.  In the end Mr. Parenton took what we proposed and came up with this ordinance instead of making door to door sales illegal it would be regulated through licenses and bonds.  Any individual that wants to sell door to door must get a license and post a bond to do so.  Bottom line it won’t run off anybody who is legitimately in business and deter those who are not legitimately in business.  This ordinance strictly deals with sales that are not being delivered on site.  A motion was made by Councilman Daniel Satterlee with a second by Councilwoman Teri Casso to move this item to full council.

Meeting held at the Courthouse Council Mtg. Room:

The meeting took in at 5:33 pm on Tuesday, March 12, 2013. 

Present: Chairman Dempsey Lambert, Vice-Chairman Randy Clouatre, Councilwoman Teri Casso, Councilman Todd Lambert and Councilman Oliver Joseph. Parish President Tommy Martinez and Ken Dawson were also in attendance of the public meeting.

Absent: None

Councilman Randy Clouatre led the invocation and the pledge of allegiance. 

Public Comment Period – Chairman Lambert instructed anyone wishing to speak on any agenda item to please sign up with the secretary. 

Road Department monthly report for March 2013 – Public Works Director, Ronnie Fairchild reported that Public Works Road &amp; Bridge crews worked a total of 217 work orders during the month of March. They cleaned approximately 8900 feet of roadside ditches and cleaned out 6500 feet of culverts.  Weed control cut approximately 168 miles of roads and sprayed 70 miles (down due to wind). Public Works Environmental Supervisor,  Mr. Don Hysell reported a total of four (4) lot violation processed with one needing to be cut by contractor due to non-compliance, two (2) are to be re-inspected next week and one is pending the 15 day waiting period allowed. He also reported that he processed four (4) litter violations which will be re-inspected next week also.  Don also reported on the 2013 Household Hazardous Materials Collection Event held at Lamar-Dixon on April 3rd. He reported a total of 303 vehicles dropped off household items by parish residents. The monthly Recycling Road Show at Wal-Mart in Prairieville had a total of 156 vehicles dropping off recyclable items. Both events were very successful. Ronnie thanked the Grants Department for their work on getting grant funds to install solar stop signs at various intersections throughout the parish. Ronnie also presented a list of  locations where solar blinking stop signs have been installed with another twenty-two signs on order for future placement at various intersections. Ronnie stated that crash data was used for installation sites. Councilman Clouatre thanked Ronnie for these sign installations stating that he is sure they have already prevented many accidents at dangerous intersections. 

Road Projects update report – Chief Engineer Ben Laurie began by giving an update on all active parish and state road projects as follows:

Ben requested President Martinez’s assistance in contacting DOTD for an update on the LA 431/Goldplace Turn Lane Project which has been held up for quite some time while selecting a design consultant. Ben also gave an update on the Pavement Preservation Program which will be used in determining which roads are in most need of repairs. President Martinez thanked Ben for his hard work in compiling all the information received from DTS into our CarteGraph System, software used for inputting road data base. Ben’s presentation demonstrated how the system will then tell what kind of maintenance is required when running a particular scenario while using budgeted amount in determining the road maintenance project list for a given year. President Martinez commented that a development is being built in the area near Jack LeBlanc Road near Sno’s Seafood. DOTD is requiring the developer to build a road which would be a straight shot to Airline Highway. He said the road would be built according to DOTD standards if the committee so approves. He also spoke of another meeting held with developers and real estate agents about the collection of a road maintenance fee for new homes purchased in new developments. He recommended to the committee to amend the Planning Commission’s Subdivision Codes to include an annual $100 road maintenance fee to be collected from home buyers in upcoming developments in the parish. The monies collected would be used for maintenance in the development the lot was sold and over thirty (30) years would produce $3,000 per lot. The average life of a road is 15 – 20 years and possibly longer is well maintained. This fee would generate the road maintenance funds to keep roads in subdivisions up to standards. Councilman Teri Casso made a motion to approve sending the recommendation to the Planning Commission for an amendment to the subdivision codes to include an annual $100 road maintenance fee in the form of a developmental agreement with the Parish. Councilman Todd Lambert made a second to the motion. No objections. Motion passed as a recommendation to the Planning Commission. 
  
Change Order No. 2 for the Roddy Road Widening (LA 621 – LA 931) – Ben explained this change order for the addition of twenty-six (26) rain days only with no change in costs to the contract due to adverse weather earlier this year. A motion to approve was made by Councilman Todd Lambert. Councilman Clouatre made a second to the motion. No objections. Motion passed to council for approval.

Work Change Directives #1 and #2 for the 2012 Road Improvements Project – ENG-11-050- Ben presented these change directives, one due to floralite on six (6) roads, which will be moved to the end of the project for reconstruction with additional costs. Ben recommended to the committee the additional costs in the form of a change order for the removal of floralite and start with a new road base, pending approval. The second is due to the reduction in length of work and costs on Quail Creek Avenue due to bad section of road only and not entire road length. Ben is asking approval of both change directives which will ultimately be Change Order No. 1 estimated at $353k increase to the original contract amount, but still under the original amount budgeted for this project. Ben explained to the committee that other areas of floralite may be discovered in patches, but that committee and council approval are required before proceeding. He asked the committee for a recommendation for proceeding and not holding up the project. Councilman Clouatre explained that he is aware of the floralite patching done in past years and that some we know of and some are found during the testing stages early on in road projects which ultimately require additional costs to remove. They have also discovered that just putting material over the floralite is not a permanent fix. In this case with these roads we were aware there was floralite but testing reports only revealed those areas where samples were taken, depending on the type of test ran.  The committee discussed what action could be approved with President Martinez who stated that he does not have any problem with an increase to the contact as long as it does not go over the amount budgeted which is approximately $5.1 million with the low bid and contract amount of approximately $4.3 million. Ben would come back to the committee for approval of any additional increase to the contract other than this first change order for approximately $353k, which would be over the budgeted amount. He will also report to this committee any other change orders, which has been the practice by this committee for the past years. Ben had this happen in last year’s project where floralite was discovered and milled and then got rained out and turned into a mess. The road was in such terrible condition that Ben had no choice but to get an estimate to reconstruct the road and do a change directive and ultimate change order which he is asking the committee to address these situations and how to proceed. President Martinez reassured Ben to continue to report any change directives which would lead to a change order while reporting monthly to the committee and to the administration in this same manner.  Chairman Lambert also recommended not holding up or stopping project but to assess any issues at the end as with these six roads. Councilman Clouatre would like to see the parish reconstruct these floralite areas with a permanent fix rather than cover them with material only to have problems in the future. Councilman Todd Lambert made a motion to approve proceeding with the road project and approval of the change order, while staying within the budgeted amount and reporting any additional change orders for the project to this committee at the next available meeting. Councilwoman Casso made a second to the motion. No objections. Motion passed to the council for approval.

Roads for acceptance into the Parish Maintenance System discussion as follows: Mr. Alan Braud over DPW’s Inspection Department reported the following roads as having been inspected, found in good
condition and made a recommendation to accept the following roads in Pelican Crossing’s, 3rd Filing: 

a)  Coushatta Drive…………………692 feet – Councilman Todd Lambert made a motion to accept. Councilwoman Teri Casso made a second to the motion. Motion passed to council for approval.
b)  Pelican Crossing Drive………………1060 feet – Councilman Oliver Joseph made a motion to accept. Councilman Todd Lambert made a second. Motion passed to council for approval.
c)  Toledo Avenue………….2482 feet – Councilman Todd Lambert made a motion to accept. Councilman Joseph made a second to the motion. Motion passed to council for approval.

The next group of asphalt roads being recommended for acceptance by the Inspections Department are located in Stonegate Manor Subdivision as follows:

After further discussion Councilman Todd Lambert made a motion to accept. Councilman Clouatre made a second to the motion. Motion passed to council for approval.

Resolution for the STP&gt;200k Project Submittal List Revision – Ray Miller presented this list revised to include a section of Roddy Road (LA 621 S –  LA 935) Widening Project under the safety improvements part of the program. He explained that by changing the road classification at the state and federal level for Roddy Road to an Urban Collector in the Functional Classification System it becomes eligible for the STP&gt;200k Program. The other projects in this submittal include the Data Transfer Solution Road Scan for the collection of road data as well as, feasibility studies for the intersections of LA 73 at LA 429 (Cornerview Road) and LA 22 at LA 429 (Weber City Road). Upon Ray’s recommendation for approval, Councilman Clouatre made a motion to approve. Councilman Todd Lambert made a second to the motion. No objections. Motion passed to council for approval. 

After a brief discussion with President Martinez expressing his contentment with the parish now capturing federal funds after many years of not doing so, Councilman Todd Lambert made a motion to adjourn.
Councilman Joseph made a second to the motion.
